City recommends exemption from Interim Control Bylaw

Monday’s city council meeting should be interesting and will demonstrate how committed councillors are to remaining “consistent” and not setting “precedent” regarding both the interim and demolition control bylaw.

It is interesting to note, that in their report this time, Administration gave a choice to councillors – to exempt or not exempt.  I don’t recall that option being given in any other report regarding  exemptions to the bylaws.

However, administration is recommending that Maryvale’s proposed development of a one-storey residential treatment building be approved and that the project be exempted from the interim-control bylaw.

City administrators state:

Council may consider an exemption from the Interim Control By-law for this facility because (a) the building to be built and the services it will provide are clearly in the public interest, in that they will provide critically needed public health facilities; (b) The building will not impair heritage/archaeological resources; (c) there is also urgency and a public interest in proceeding with construction in order not to risk loss or impairment of the provincial $2 million grant.

So here we have the conditions for exemption:

  1. It is in the public interest.
  2. The project will not impair heritage/archaelogical resources.
  3. Risk of losing a provincial grant

Too bad for Norm Wilson, the Sandwich Town resident who wanted to replace his crumbling garage which threatened the safety of his grandchildren.  His application was denied.  But clearly replacing a crumbling garage is not in the public interest.

I suppose building a greenspace in conjunction with community partners is also not in the public interest and boarded up homes that could become targets for vandals and arsonists is.  The Detroit International Bridge Company’s application was also denied, even though consultants found no significant heritage qualities of the now boarded up homes.

It will be interesting to see how Councillor Ron Jones will vote, unless of course he is suddenly ill that day.  In a Windsor Star editorial (The Garage Debate, The Windsor Star, September 19th, 2007), the councillor is quoted as stating:

“Certainly these are good people, but we have to look at the big picture. We cannot cherry pick who is worthy and who is not,” said Jones, the acting mayor, who cast the vote that resulted in the deadlock. “Someone mentioned our high-priced lawyers. Certainly we will need more if we create a crack in the interim control bylaws.”

And what is truly amazing is that city solicitor, George Wilkki and Lee Anne Doyle, Acting Executive Director Building & Development while recommending exemption for Maryvale, had this to say about Norm Wilson’s garage (City won’t OK razing of eyesore, The Windsor Star, September 18th, 2007):

“Giving Wilson approval to take his garage down would be a dangerous precedent, warned City Solicitor George Wilkki.”

Several administrators agreed, including chief building inspector Mario Sonego, acting city planner Thom Hunt and acting executive director of building and development Lee Anne Doyle.

Then again, these are some the same administrators who warned some members of council they may be in conflict over the WUC matter and then later claimed they were not.

Adminstration also warns that Maryvale could lose a provincial grant for their project if they are not exempted. 

But where is the proof of this claim? Has the province threatened to cancel the grant should construction not proceed in a timely manner?  Is there a deadline?  Why is this not mentioned in Administration’s report?  The risks involved with other applicants being denied an exemption were not considered such as garages falling down on young children or the potential impact of boarded up homes on public safety.

So will councillors continue to remain “consistent” and not “cherry pick?” Monday should be very interesting.

In the words of councillor Percy Hatfield regarding Wilson’s application, “On merit, I love the plan, but we cannot make decisions on who is a nice guy. We should be here to do planning on a consistent basis.”

The majority of councillors approved the interim control bylaw knowing full well the negative impacts it could have on neighbourhoods. 

They have also repeatedly stated how important it is to not set precedent.

There is only one way that individuals, neighbourhoods and taxpayers can be protected – I wonder if any councillors have the courage and conviction to undertake that task.

  1. At the recent Planning Advisory Committee meeting, Councillor Postma mentioned, in supporting two recent rezoning applications in the Area of Continued Analysis subject to the environmental assessment for DRIC (and location of the GreenLink) that she did not want to ’stymie development’.

    You have to love our Council.

    Maryvale must be a “point of impingement”, it appears… Try to put a backdoor now.
    No back door and no front door either? Maybe they like to see Huron Church from EC Row to Tecumseh (the real name of this streatch is Huron Line) put back to 4 lanes. After all, it’s the only way to help Mr Wilson and Sandwich Towne as well as Indian Rd.

    Mr Wilson got shafted bigtime and no matter what fight the city is in, with whoever, they have NO NO NO right to do that to Mr Wilson. And boarded up homes on Indian Rd and Mr Wilson are two completely different stories.
    Mr Wilson got jerked over because the houses on Indian had to be boarded up. (and the place is cleaner ever since.) Were not going to forget Mr Wilson, and I don’t think the city will either. But I remember their consistancy talk and didn’t like it, and thought there was a better way to handle that…. The city owes Mr Wilson…

  3. The fools have backed themselves into a corner. But it seems they’d rather see citizens risk injury in unsafe buildings, rather see the west end deteriorate ever further, watch property values drop more and more then admit they’re wrong. There isn’t one property owned by the ABC that is heritage, and none are worth saving at this point. Standing firm on a bad policy just shows they’re more interested in their own political health then the health and prosperity of the city.

WELL WELL LETS SEE HOW THE CITY CAN GET AROUND THIS ONE.LETS SEE HOW CONSISTENT THEY WILL BE MONDAY NIGHT.LETS SEE IF MR JONES AND MR HATFIELD LIKE MARYVALE PLAN BUT HAVE TO BE CONSISTENT.LETS SEE IF THEY GO AGAINST ADMINISTRATION ON THIS ISSUE WHEN ADMINISTRATION WENT AGAINST MR.WILSON AND HIS GARAGE.THE CITY COUNCILORS SAID THEY DIDN’T WANT TO ACT LIKE A THREE RING CIRCUS ANY MORE AND THEY JUST KEEP GETTING DEEPER AND DEEPER INTO TROUBLE.LETS SEE WHAT THE NEXT COUNCIL SESSION BRINGS.NOTHING IS A SURPRISE ANY MORE IT WOULD BE A SURPRISE IF THEY DID SOMETHING RIGHT FOR A CHANGE.

  5. ABC must have hired Elite Security. They been prowling the neighborhood last couple days. I’ve been seeing two cars at a time in the parking lot under the bridge. I think their scard of firebugs or something. I think ABC still has the services running in their houses because sometimes there are lights on. It’s not safe to have the service on, if it’s boarded up? is it? What about a gas leak?

    I think the interem bylaws will end Jan 09 2008 unless city council votes to extend an additional one year. But in the meantime they don’t want to have a whole bunch of Mr Wilson’s hanging around. There intentions must be to proceed with the additional year otherwise, wouldn’t they just defer until January 08 on monday?
    I think monday will be the farthest thing from consistant…

  6. We have a different set of rules everyday with this council!! Let the snow go to 6″ before you will clean it, did our taxes go down, sure they did?? A Bylaw is a Bylaw is a Bylaw!! It is NOT different for each person. If you change it for Maryvale; then Mr. Wilson gets the same Bylaw change and then the Bridge gets that change!! Close the Ambassador for repairs and see how fast the second span goes ahead. If we wait for Windsor City Council to decide who they like on a given day it would never happen like Norm’s garage.

  7. City council now has the perfect opportunity to amment the by law and be fair to everyone……So lets see what happens monday on council.If they approve maryvale the i guess Mr Wilson can start to build his garage.Good luck….

I heard Ron Jones on the news tonight.It makes me sick the games they are playing.He says maryvaille is a need not a want so he is supporting them.Who is he to decide what is a need.It makes me wonder want end of town he lives in.Because i know you can;t leave a harley and 4wheeler out in the open in the west end.It would be stolden.So i guess Mr Wilson will be getting his garage after all because he has aneed not a want.So i guess he won’t have to cherry pick after all.

  10. Hopefully it gets voted down and the voters in the west end take care of councillors “Big Cheese” and “I used to be a firefighter” at the next election. The whole city will be better off without these two (maybe we can get Junior out also).
